Probate / Administration
When someone passes away, probate or administration in the Surrogate’s Court may be necessary to distribute assets. When a person created a Will before passing, the court must determine that the Will is valid to enable the property of the estate to be distributed to those named within. This process is called probate. In cases where someone died without a Will, or a Will has been lost or destroyed, the estate will go through a similar process called administration.
There are numerous rules, procedures, and deadlines involved with these processes.
