In a recent matrimonial decision, the Nassau County Supreme Court ordered that assets be distributed disproportionately because of the Defendant’s egregious conduct during the marriage. The case joins only a handful of court decisions finding egregious conduct and awarding a distribution scheme that favors the victimized spouse. Our client was awarded one hundred percent (100%) ownership of the marital residence, eighty percent (80%) of all retirement assets, and fifty percent (50%) of the Defendant’s pension. The decision has been submitted for publication in the New York Law Journal.
